The following terms and conditions (together with the documentation referred to herein) establish the terms and conditions of use under which the services provided by The Fine Line to its users may be accessed and used (“Terms and Conditions“).

The Terms and Conditions govern the access and use of the website www.thefineline.ro (the Website“) made available by FINE FASHION SERVICES srl, with registered office in Strada Ștefan cel Mare 27, Vânători-Neamț, county of Neamț, registered with the Trade Register under number J27/198/2022, with sole registration number 45651459 (the “Company” or “The Fine Line“).

Please read the terms and conditions of use carefully when accessing the Website, as they apply to any use of the Website. By registering and accessing the services provided by The Fine Line through the Website, you declare that you have been informed and confirm that you accept these Terms and Conditions, the Privacy Policy and the Cookie Policy. If you do not agree with these Terms and Conditions, please do not use The Fine Line Website and/or services.

I. DEFINITIONS

The Company — Fine Fashion Services srl, a company with registered office in Strada Ștefan cel Mare 27, Vânători-Neamț, county of Neamț, registered with the Trade Register under number J27/198/2022, with sole registration number 45651459.

The Fine Line — is the trade name of Fine Fashion Services srl;

Services — any service listed on the website to be provided by the Seller to the User as a result of the Contract.

Seller — Fine Fashion Services srl, a company with registered office in Strada Ștefan cel Mare 27, Vânători-Neamț, county of Neamț, registered with the Trade Register under number J27/198/2022, with sole registration number 45651459.

User — any natural person who is over 16 years of age or legal entity registered on the Website, who, by completing the Account creation process, has agreed to the Website-specific terms in the Terms and Conditions section.

Nickname — nickname by which a specific User can add Content to the Website. The nickname is associated with the User’s information on the Website under the name “User Name”.

Account — the section of the Website consisting of an e-mail address and a password that allows the User to create an account and submit an Order and that contains information about the User, as well as the User’s history on the Website (orders, clothing profile, etc.). The User is responsible for ensuring that all information entered when creating the Account is correct, complete and up-to-date.

Website — online platform hosted at www.thefineline.ro

Order — an electronic document that intervenes as a form of communication between the Seller and the User by which the User transmits to the Seller, through the Website, his intention to purchase Services from the Website.

Contract — means the distance contract concluded between the Seller and the User, without the simultaneous physical presence of the Seller and the User.

Content — all information on the Website that can be viewed or otherwise accessed through the use of electronic equipment or the content of any e-mail sent to Users by the Seller by electronic means and/or any other available means of communication or any information communicated by any means by an employee/collaborator of the Seller, whether or not in accordance with contact information specified by the Seller or information relating to the Services and/or the rates charged by the Seller at any particular time;

My Order — section of the Account that allows the User to add Services they wish to purchase at the time of addition or at a later time;

Marketing Communications — means of periodic information, exclusively electronic, any type of message sent containing general and thematic information, information on products similar or complementary to those purchased, information on offers or promotions or with educational content.

Transaction — the collection of an amount resulting from the sale of services by the Seller, using the services of the card processor agreed by the Seller;

Styling Sessions — styling services provided by The Fine Line stylists for the benefit of the User, based on specific requests and needs of the User and considering the User’s answers to the Style Questionnaire. The Styling Sessions may include the following services: detailed answers and advice provided by the stylist to fashion and style related questions or requests submitted by the User, personalised styling recommendations, outfit suggestions in the form of style boards, shopping lists with links for shopping, style board revisions, as well as any tailored advice on to be provided based on the User’s request.

Style Questionnaire — style questionnaire created by The Fine Line’s stylists to identify the User’s fashion and style preferences, main physical characteristics and any details deemed necessary to create the User’s style profile.

Benefits — bonuses or rewards in any form granted to the User after the booking and payment of a Styling Session, granted according to the type of the purchase; benefits may include discounts and benefits in selected online or physical stores, discounts for the further booking of a Styling Session, invitations to shopping sessions in selected stores or to The Fine Line events, etc.

II. CONTRACT DOCUMENTS
  1. By registering an Order on the Website, the User agrees to the form of communication (telephone or e-mail) by which the Seller conducts its business operations.
  2. The notification received by the User after placing the Order is for information purposes only and does not represent acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
  3. The contract shall be deemed concluded between the Seller and the User at the moment of receipt by the User of the confirmation notice of the successful payment by electronic mail.
  4. For justified reasons, the Seller reserves the right to change the quantity or delivery time of the Services in the Order. These changes will be communicated to the User at the e-mail address or telephone number made available to the Seller at the time of placing the Order and, if applicable, will refund the amount paid.
  5. The User expressly accepts that, as a result of the Order, the Seller will provide the Services that are the subject of the Order, within the term and in the form presented on the Website.
  6. The Buyer expressly accepts that the Seller’s obligation is one of means, and not one of result, and for services rendered in full and according to the terms presented on the Website, the return is not possible, such services being considered as executed.
III. FUNCTIONING OF THE WWW.THEFINELINE.RO WEBSITE
A. CREATE AN ACCOUNT ON THE WEBSITE
  1. The Website can be accessed free of charge by anyone on any internet-connected device.
  2. In order to book and pay the services provided by The Fine Line, it is necessary to create a user account by providing personal information such as first name, last name, phone number and e-mail address.
  3. Currently, the Website allows access to certain services (“Services”), such as:
    a. registering an account;
    b. filling in the style questionnaire on the Website based on which the user’s styling profile shall be created;
    c. writing and uploading photos in the chat;
    d. placing an order;
    e. making payments;
    f. viewing your order history;
    g. writing reviews or a feedback;
    h. accessing personalised style recommendations and shopping suggestions provided by an experienced stylist.
  4. In order to access the Services offered by The Fine Line you need to create an account and set a password. To avoid unauthorized use of your account without your consent, we recommend setting a password that is not known or easily identifiable to a third party. If you have forgotten your password or it has been accidentally disclosed to a third party, we recommend that you change your password as soon as possible by entering the “Account” section on the Website or contact us at contact@thefineline.ro as soon as possible.
  5. In order to access the Services offered by The Fine Line you may also be required to fill in a style questionnaire created by The Fine Line’s stylists in order to identify your fashion and style preferences, your main physical characteristics and any details deemed necessary to create the style profile (“Style Questionnaire”). You can choose not to answer or only answer a number of questions in the Style Questionnaire, but please keep in mind that the answers to the questions in the Style Questionnaire are required in order to provide you with the best style recommendations, suited to your needs and tastes.
  6. All information submitted by the User in the form of answers to the Style Questionnaire or otherwise will be used by The Fine Line solely for the purpose of creating a style profile of the User, i.e. for the formulation of personalized style recommendations by The Fine Line stylists, and will not be disclosed to third parties.
  7. In order to create an account, you must accept the Terms and Conditions, Cookie Policy and the Data Privacy Policy.
B. ACCESS TO THE WEBSITE. GENERAL CONDITIONS FOR PLACING ORDERS
  1. The Fine Line reserves the right to screen Users and restrict their use of the Website and/or the Services in case of misuse or abuse.
  2. The User can place orders from any country within the European Union.
  3. The Terms and Conditions govern the contractual relationship between the User and The Fine Line, namely the rights and obligations established when placing an order on the Website. In using the Services, the User is required to read and abide by, at all times, the Terms and Conditions and other policies posted on the Website.
  4. All communications between The Fine Line, its stylists and the User shall be made on e-mail or via the chat implemented on the Website.
  5. The chat provider is intercom.com, which is the solely responsible for the security of the User’s information mentioned in the chat.
  6. The Fine Line shall not be liable for the provision of incorrect or incomplete data by the User nor for any loss or damage suffered by the User as a result of fraudulent use of chat by the User or other third parties.
IV. STYLING SERVICES
  1. As a general rule, the styling services offered through The Fine Line are structured as Service sessions, and, depending on the type of session purchased, they may involve, among other things:
    i. stylist’s analysis of your Style Questionnaire answers, as well as any uploaded photos and specific requests;
    ii. based on the above, the stylist will prepare a series of styling recommendations, fashion advice and shopping lists formulated specifically for you;
    iii. depending on the type of service purchased, the stylist’s recommendations may include outfit suggestions in the form of style boards, shopping lists with links to recommended products, personalised fashion advice, items reviews, style revisions, one-on-one sessions, etc.
  2. The Service sessions provided by The Fine Line are at the following: Express Styling Session, Premium Styling Session and Fully Tailored Styling Session.
  3. To access Premium Styling services, the User has the right to schedule a video or audio consultation session (depending on the User’s preference) with the assigned stylist, lasting a maximum of 30 minutes. The platform on which the video or audio consultation session will be organised is external and not owned by or directly associated with The Fine Line.
  4. All information submitted by the User during the video or audio consultation session will be used by The Fine Line solely for the purpose of creating a stylistic profile of the User, i.e. for making personalized style recommendations, and will not be disclosed to third parties. The Fine Line will not store video or audio content related to the video or audio consultation session.
  5. The prices set for the booking of the styling sessions are expressly mentioned on the Website and range between EUR 60, respectively approx. 290 RON for the Express Styling service to EUR 245, respectively approx. 1,200 RON for the Premium Styling service and will be paid by the User at the time of placing the order. The cost of the Fully Tailored service will be transmitted to the User after receipt of the request for quotation for such service.
  6. The price of styling services is not subject to refund or return policy, unless the User will not be provided with the styling recommendations according to the specifics of the session the User’s booked or the User will be provided with the styling recommendations according to the specifics of the session the User’s booked with a delay of more than 72 working hours as of the time mentioned in the sessions’ descriptions, unless such delay is due to the User.
  7. In the events mentioned under 4.6. from above, the User shall be entitled to ask for a refund. In such case, the User is required to write at contact@thefineline.ro requesting a refund. In case of refund approval, the refund will be transferred using the User’s original payment method. Depending on the User’s payment provider, it may take 1 to 30 days for the amount to appear in the User’s bank account.
  8. Following the payment confirmation, the User will receive styling recommendations from The Fine Line stylists according to the specifics of the session the User’s booked, within the timeframe specified on the Website. Such timeframe fully depends on the type of the styling session and range between 24 working hours as of payment confirmation (for the Express Styling Session) to 72 working hours as of payment confirmation (for the Premium Styling Session). The timeframe applicable for the Fully Tailored Styling Session will be mentioned directly to the User depending on the User’s requests. However, the customized quotation for the Fully Tailored Styling Session will be provided to the User via e-mail within 72 hours as of the date of the request.
  9. The styling recommendations will be received by the User via chat within 24 working hours as of payment confirmation for the Express Styling Session and 72 working hours as of payment confirmation for the Premium Styling Session. The User will also be notified on the e-mail address registered on the Website regarding the status update of the User’s active Styling Session, as well as the styling recommendations provided by the stylist.
  10. Depending on the Styling Session, the User will have between 48 hours and 72 hours as of receipt to respond and provide feedback to these recommendations. Within this period, the User has the opportunity to let the stylist know if he is satisfied with the recommendations received or if the User wishes to receive different or similar recommendations, specifying the User’s requirements. If the User does not inform The Fine Line within 72 hours of receiving the recommendations of the User’s decision to ask for a revision of the recommendations, the User will be deemed to be satisfied with the recommendations received, the chat will close and the revision option will no longer be available.
  11. If the User is objectively unable to provide feedback within 72 hours as of receipt, the User is required to write at contact@thefineline.ro and ask for an extension for the feedback session.
  12. The Fine Line takes no responsibility for the availability and the quality of products mentioned in shopping lists transmitted to Users. All products mentioned as a result of the styling process are of a recommendatory nature and are not binding on the User. The User may or may not purchase these products, this action being entirely at the User’s discretion and responsibility.
  13. The availability of the products mentioned in the shopping lists is in no way dependent on The Fine Line, and The Fine Line does not guarantee the availability of these products or the stocks of the stores after the time of transmission of the shopping list to the User.
  14. In the event that the User attempts within 72 hours to purchase products mentioned in the shopping lists sent to them by The Fine Line’s stylists and such items are no longer available, the User can request the stylist to provide similar recommendations.
  15. The User may exercise the right of withdrawal with respect to the styling service up until the moment of receipt of the payment confirmation. After the payment confirmation, the stylist begins the evaluation of the User’s profile and the styling process begins.
  16. If the User wishes to withdraw before the payment confirmation, he/she must contact The Fine Line in due time, by e-mail at contact@thefineline.ro
  17. By accepting these Terms and Conditions, the User consents to the performance of the styling services and declares that he/she understands that, once they have been performed, he/she will lose the right of withdrawal.
V. PAYMENT INFORMATION
  1. Invoicing and payment of the Styling Session booked by the User will be done at the time of placing the order, i.e. after the User has selected the type of service and placed it in the shopping cart.
  2. The price of the Styling Session is expressed in EURO or RON, depending on the currency selected by the User, will be invoiced in RON.
  3. All financial transactions and payments made for the purchase of services provided through the Website are processed by the external payment processor, PLATI.ONLINE ( www.plationline.eu ) and stored on its servers.
  4. The Website ensures a level of security that complies with the requirements of remote electronic payment systems.
  5. The card data processing is done exclusively on PlatiOnline servers. The safety of the User’s information is guaranteed by the fact that PlatiOnline does not store the confidential data of User’s card, but sends such data encrypted over a secure connection to the processing bank. In this way, the safety of the User’s data is ensured.
  6. The payment provider is the solely responsible for the security of the User’s card transactions.
  7. All connections and communications between the Website, The Fine Line systems and the payment processor are encrypted and secure. For more details on how your information is stored and the security of your transactions, please visit the payment processor’s page, www.plationline.eu
  8. The Fine Line shall not be liable for the provision of incorrect or incomplete data by the User nor for any loss or damage suffered by the User as a result of fraudulent use of payment methods by the User or other third parties.
VI. PAYMENT METHODS
  1. The only accepted payment methods for purchasing the Styling Session by the User are either by card or payment link (in case of the Fully Tailored Styling Session or subscriptions).
  2. The User can pay online with User’s personal or company card, in safety conditions. The cards which are accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have code CVV2/CVC2).
  3. No additional commissions are charged for the payment transactions made on the Website.
  4. Regardless of the currency of the User’s account, the transactions are made in RON or EUR, at the rate of exchange of the User’s bank.
  5. For card payments, the transaction will appear on the User’s account statement with the name thefineline.
VI. SPECIFIC CONDITIONS FOR SUBSCRIBERS/RECURRING CUSTOMERS
  1. The Fine Line may offer its returning Users the opportunity to access the Services on a subscription basis (“Subscription“). The Subscription involves the booking of the Styling Service chosen by the User on a monthly or quarterly basis (depending on the type of Subscription selected).
  2. To obtain a Subscription, the User must follow the registration steps set out in Section 1, fill in the Questionnaire and contact us by e-mail at contact@thefineline.ro specifying the type of subscription desired.
  3. The Fine Line offers companies the possibility to purchase a subscription that gives access to the Service Sessions for a larger number of people. To benefit from this type of subscription at a special price, the company or the User must contact us by e-mail at contact@thefineline.ro specifying the type of subscription desired.
  4. Types of Subscriptions:
    i. Monthly Subscription: The User will receive styling recommendations according to the Express Styling or Premium Styling service every month;
    ii. Quarterly Subscription: The User will receive styling recommendations according to the Express Styling or Premium Styling service every three months.
    iii. Corporate Subscription: The styling recommendations according to the Express Styling or Premium Styling service will be received by a predefined number of people.
  5. The price of the Subscription, as well as access to the services related to each type of Subscription, will be governed by the Terms and Conditions applicable at the time of purchase, and your acceptance of these Terms and Conditions constitutes your agreement to enter into this contract and to pay for the Subscription until it is terminated.
  6. The Fine Line can offer discounts and benefits to Users when purchasing subscriptions.
  7. Prices and terms of payment are subject to the general terms and conditions set out in the Terms and Conditions.
  8. The duration of the purchased subscription is indefinite.
  9. You have the option to request termination of your Subscription at the end of the contract month in which you requested termination.
  10. The Subscription shall terminate in one of the following situations: (a) following a termination request by the User; (b) by termination by The Fine Line in the event of non-payment or breach of the provisions of the Terms and Conditions; (c) in any other manner provided by law.
VIII. GIFT CARDS
  1. The Fine Line may allow the purchasing of Gift Cards at any given time and at its discretion.
  2. The Fine Line Gift Card allows the cardholder to access any The Fine Line Service in exchange for and within the credit available on the Gift Card. If the available credit is not sufficient to cover the cost of the services, the holder will bear the difference between the cost of the service and the available credit.
  3. The Gift Card cannot be used to purchase other Gift Cards nor can it be resold or exchanged for cash.
  4. Credit available on a Gift Card cannot be transferred to another Gift Card.
  5. Ownership and risk of loss of the Gift Card is transferred to the Customer or the Gift Card user at the time the Gift Card is issued by The Fine Line. The Fine Line will not be liable for loss, theft or destruction of the Gift Card or for unauthorized use of the Gift Card by a third party without the cardholder’s consent.
IX. LOYALTY PROGRAMMES
  1. The Fine Line may reward Users who refer The Fine Line to others.
  2. Referrals are made by sending a referral link from the User to other people. It is forbidden to send referral links to yourself or to another address of the same User.
  3. Through referrals, both the User and the person receiving the referral will receive benefits or discounts in the form of a credit to The Fine Line account.
  4. If you refer us, the benefits will be added to your account when the referred person places their first order on the Website and can be used to purchase styling services.
  5. We reserve the right at any time to change the conditions of participation in the referral program, to discontinue or stop it for certain Customers.
  6. The Fine Line may provide its users or others with promotional discount codes or other such benefits for the purchasing of styling services.
  7. Promotional codes cannot be combined under any circumstances. Only one promotional code can be applied to an order. A coupon code can be applied only once in each partner store or on the Website.
  8. Each promotional code may be subject to the terms and conditions communicated by The Fine Line at the time of code issuance.
  9. The Fine Line may reward Users after purchasing styling services by granting them discount codes to be used in selected physical or online stores. A discount code can be used only once for the User’s shopping session in a selected store.
X. LIMITATION OF LIABILITY
  1. The Fine Line shall in no event be liable for any damage or loss suffered by the User as a result of acts attributable to the latter or to third parties, such as but not limited to:
    i. improper use of the Services by the User;
    ii. any shopping orders made by the User;
    iii. incompatibility of style recommendations with User preferences;
    iv. force majeure (understood as an event beyond the control of the parties, which is not due to their fault or negligence, which could not have been foreseen at the time of the conclusion of the contract and which makes it impossible to perform and fulfil the obligations respectively; such events are considered to be: wars, revolutions, fires, floods or any other natural disasters, major technical difficulties of the Website or the servers serving it, restrictions arising from quarantine, pandemics, embargoes, strikes, the list is not exhaustive but is enunciative);
    v. incorrect or incomplete information provided by the User when placing orders.
  2. In any event, The Fine Line’s liability to the Customer shall not include the loss of the Customer’s profits and shall be limited to the maximum amount paid by the Customer to The Fine Line for the order in relation to which the damage was claimed.
  3. The Fine Line does not in any way guarantee or warrant the availability or quality of the garments contained in the style recommendations made by The Fine Line stylists.
XI. LINKS TO THE FINE LINE WEBSITE
  1. You may submit to our Website through a link, as long as you do so in a fair manner that does not damage our reputation and does not take advantage of our reputation for personal gain.
  2. You must not link in such a way as to suggest in any way any form of association, endorsement or support from us when no such situation exists. You must not link to the Website from a website that you do not own. We reserve the right to withdraw the right to link to our website without prior notice.

XII. INTELLECTUAL PROPERTY RIGHTS
  1. The Website, its component elements, graphics, and content are owned by The Fine Line, and the user of the Website understands that he or she has no rights in them except for the limited right of use under these Terms and Conditions.
  2. All information displayed on the Website is the property of The Fine Line or its partners and is protected by copyright or other intellectual property rights under the law.
  3. No image, trademark or sign belonging to The Fine Line or its partners may be used or third parties without the prior written consent of the owners.
  4. All company names, trademarks, trade names, logos and logos are protected by applicable intellectual property rights rules. Nothing contained on the Website should be construed as granting any license or right to use any Trademark displayed on this Website without the written permission of The Fine Line or such third party that may own such Trademarks.
  5. The following shall be forbidden:
    i. using the Website for illegal purposes;
    ii. making derivative works, sub-licensing, lending or otherwise using the Website, the software underlying the Website or any of its components for any other purpose;
    iii. republication of materials uploaded to the Website (including republication on various online and/or offline sites or platforms);
    iv. public presentation of any material uploaded to the Website;
    v. reproducing, copying or exploiting material uploaded to the Website for commercial purposes;
XIII. LIMITATION OF LIABILITY FOR WEBSITE CONTENT
  1. The entire contents of the Website are provided on an “as available”, “as is” basis without any warranties of any kind either express or implied, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
  2. The Fine Line does not guarantee the accuracy, completeness, timeliness or certainty of any content made available through the Website. Users are responsible for verifying any information before relying on it. Use of the Website is at the user’s own risk.
  3. While we make every effort to ensure that The Fine Line services are accessible, we cannot guarantee that the Website will be error-free or that there will be no errors or omissions in its content. We also cannot guarantee that the Website and its content will be accessible at all times without interruption. We shall not be liable in the event that the Website cannot be accessed, regardless of the reason for the impossibility of access and regardless of the duration of such impossibility.
  4. We will also not be liable for any damage caused by a virus, denial-of-service or distributed denial-of-service attack, or any other type of technological material that infects the user’s computer, IT system or data as a result of the use of our Website or other websites to which the Website links.
  5. We do not guarantee that the Website will be secure or virus-free. The User is responsible for configuring IT systems for access to the Website and for using their own anti-virus software. You must not misuse the Website by introducing viruses, Trojan horses, worms or other material that may create technological problems. You must not attempt to gain unauthorised access to the Website or allow any third party to access it.
  6. It is forbidden to attack with denial-of-services or distributed denial-of-services attacks. By violating this provision, you are committing a crime under Romanian law and we will report any such violation to the appropriate investigative authorities and cooperate with the authorities by providing your identity to them. In the event of such a breach, your right to use this Website immediately ceases.
XIV. CHANGING THE TERMS AND CONDITIONS
  1. The Fine Line may revise these terms and conditions of use and any other applicable terms at any time by updating the relevant pages. The Terms and Conditions are subject to change without prior notice and will be posted directly on the Website. Please check the relevant pages for any changes to the terms and conditions of use, as such changes will apply from the time of update. If you use the Website after a change, you accept the amended Terms and Conditions.
  2. The Fine Line reserves the right to update the Website, services and offers at any time and to change its content. However, please note that the Website may be out of date at the time of viewing, and The Fine Line is under no obligation to update in real time.
  3. The Fine Line makes every effort to provide you with all versions of the Terms and Conditions applicable to you. However, if you do not see on our website the version that applies to you or that you are interested in, please contact us at any of the contact details on the website and an operator will provide you with any version of the Terms and Conditions by email as soon as possible.
XV. SUPPORT AND ASSISTANCE

While using our services, The Fine Line provides a support team. The support service can be accessed on working days (Monday to Friday, except public holidays) between 10.00 and 18.00 at contact@thefineline.ro

XVI. APPLICABLE LAW

Romanian law is applicable to these terms and conditions of use and any matters relating to or in connection with their content. By accepting the provisions contained in the Terms and Conditions of the Website, you agree that any matter or dispute arising out of these terms and conditions shall be subject to the jurisdiction of the competent courts of Romania.
